On June 30, the court struck down Donald Trump’s Executive Order No. 14160 of January 20, 2025, which barred U.S. citizenship from being granted to children born in the country if their parents did not have a lawful right to reside there or were in the United States temporarily, for example on a tourist visa.
The court thus confirmed that the 14th Amendment to the U.S. Constitution, which guarantees citizenship to everyone born on the country’s territory, must be applied directly and without additional restrictions.
Six of the nine Supreme Court justices voted for the decision. It effectively nullifies Trump’s order and deprives the president of the ability to change the rules for granting citizenship by “right of soil” through new executive orders.
At the same time, Trump said on Truth Social that he would still seek to revise the rules for granting birthright citizenship “with or without the Supreme Court.”
